1. Agreement
These Terms and Conditions (“Terms”) govern the provision of electrical services by Elix Electrical Services ABN 57 748 060 099 (“we”, “us”, “our”, “the Company”) to you (“you”, “your”, “the Customer”). By engaging our services or using our website (https://elixelectricalservices.com.au), you agree to be bound by these Terms.
2. Definitions
- “Services” means all electrical services provided by us including but not limited to installations, repairs, maintenance, consultations, and emergency services
- “Quote” means a written estimate of costs for specified work
- “Work” means the electrical services to be performed as agreed
- “Site” means the location where Services are to be performed
3. Services
3.1 Scope of Services
We provide residential and commercial electrical services including:
- General electrical installations and repairs
- Landscape and security lighting
- EV charger installations
- Smart home solutions
- Switchboard upgrades
- Commercial fit-outs
- Emergency electrical services
3.2 Electrical Licence
We hold the following licences:
- Electrical Contractors Licence: 305788C
- Registered Cabler Licence: T56363
4. Quotes and Pricing
4.1 Quotes
- Quotes are valid for 30 days unless otherwise stated
- Quotes are based on information provided and site conditions observed
- Additional costs may apply if unforeseen issues arise or scope changes
- Fixed price quotes are subject to the assumptions and exclusions stated
4.2 Variations
- Any variation to the agreed scope must be approved in writing
- Variations will be charged at our standard rates
- We will notify you of any cost implications before proceeding
4.3 Travel and Call-Out Fees
- Standard call-out fees apply for service visits
- Additional charges may apply for services outside normal business hours
- Travel costs may apply for locations outside our standard service area
5. Payment Terms
5.1 Payment Schedule
- Residential Work: Payment due upon completion unless otherwise agreed
- Commercial Work: As per agreed payment schedule
- Large Projects: 50% deposit may be required before commencement
5.2 Payment Methods
We accept:
- Cash
- Bank transfer
- Credit/debit cards
- EFTPOS
5.3 Late Payment
- Payment terms are strictly 7 days from invoice date unless otherwise agreed
- Late payment fees of 2% per month apply to overdue accounts
- We reserve the right to suspend services for overdue accounts
- Legal costs incurred in debt recovery will be charged to the Customer
6. Customer Obligations
You must:
- Provide accurate information about your electrical requirements
- Ensure safe access to the work site
- Obtain necessary permits and approvals (unless we agree to arrange)
- Notify us of any hazards including asbestos
- Ensure the site is ready for work to commence
- Be present or have an authorised representative available
- Promptly pay all invoices
7. Work Performance
7.1 Standards
- All work will be performed in accordance with AS/NZS 3000:2018 (Australian Wiring Rules)
- Work will comply with relevant Australian Standards and local regulations
- We will use quality materials that meet Australian Standards
7.2 Timing
- We will use reasonable efforts to complete work within agreed timeframes
- Timeframes are estimates only unless specifically guaranteed in writing
- Delays due to weather, supplier issues, or matters beyond our control will extend timeframes
7.3 Testing and Certification
- We will test all work according to industry standards
- Electrical safety certificates will be provided where required
- Certificates of Compliance will be issued for relevant work
8. Warranties and Guarantees
8.1 Workmanship Warranty
- We warrant our workmanship for 12 months from completion
- This warranty covers defects in installation but not normal wear and tear
- Warranty is void if work is modified by others
8.2 Product Warranties
- Products are covered by manufacturer warranties
- We will assist with warranty claims but are not responsible for manufacturer defects
- Warranty periods vary by product
8.3 Consumer Guarantees
Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law.
9. Cancellations and Postponements
9.1 By Customer
- Cancellations must be made at least 24 hours before scheduled work
- Cancellation fees may apply for less than 24 hours notice
- Deposits are non-refundable for custom-ordered materials
9.2 By Us
We may cancel or postpone work due to:
- Unsafe conditions
- Extreme weather
- Customer breach of these Terms
- Non-payment of deposit
10. Liability and Indemnity
10.1 Limitation of Liability
To the extent permitted by law:
- Our liability is limited to re-performing defective work
- We are not liable for indirect or consequential losses
- Our total liability will not exceed the value of the relevant Service
10.2 Exclusions
We are not liable for:
- Pre-existing defects or non-compliant work by others
- Damage from hidden conditions not reasonably discoverable
- Loss arising from your failure to maintain electrical systems
- Power surges or supply issues beyond our control
10.3 Insurance
We maintain:
- Public liability insurance
- Professional indemnity insurance
- Workers compensation insurance
11. Safety
11.1 Work Health and Safety
- We comply with all WHS legislation
- You must comply with our safety requirements on site
- We may stop work if safety concerns arise
11.2 Electrical Safety
- Do not attempt electrical work yourself
- Report any electrical hazards immediately
- Follow our safety advice and warnings
12. Privacy
Your personal information is handled in accordance with our Privacy Policy available on our website.
13. Intellectual Property
- Designs, plans and specifications remain our property unless paid for in full
- You may not use our designs for work performed by others without consent
- Our business name and logos are our trademarks
14. Complaints and Disputes
14.1 Complaints Process
- Contact us immediately with any concerns
- We will investigate and respond within 5 business days
- If unresolved, we will work with you to find a solution
14.2 External Disputes
If we cannot resolve your complaint:
- NSW Fair Trading: 13 32 20
- Electrical safety complaints: SafeWork NSW
14.3 Dispute Resolution
Disputes will be resolved through:
- Good faith negotiation
- Mediation if negotiation fails
- Legal proceedings as a last resort
15. Subcontractors
We may engage qualified subcontractors to perform work. We remain responsible for the quality and completion of all work.
16. Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control including:
- Natural disasters
- Government actions
- Supply chain disruptions
- Pandemic restrictions
17. Termination
17.1 Termination by Either Party
Either party may terminate the agreement by written notice if the other party:
- Breaches these Terms and fails to remedy within 7 days
- Becomes insolvent or bankrupt
17.2 Effects of Termination
Upon termination:
- Work will cease
- Payment is due for completed work
- Materials ordered remain your responsibility
18. General Terms
18.1 Entire Agreement
These Terms and any Quote constitute the entire agreement between us.
18.2 Variations
Changes to these Terms must be in writing and signed by both parties.
18.3 Severability
If any provision is invalid or unenforceable, the remaining provisions continue in effect.
18.4 Governing Law
These Terms are governed by the laws of New South Wales, Australia.
18.5 Jurisdiction
The parties submit to the non-exclusive jurisdiction of NSW courts.
19. Special Conditions
19.1 Asbestos
- Additional charges apply for work involving asbestos
- Specialist removal may be required at your cost
- Work will comply with asbestos regulations
19.2 After-Hours Work
- Emergency rates apply outside business hours
- Minimum charges apply for emergency call-outs
19.3 Strata Properties
- Strata approval is your responsibility
- We may require written approval before commencing
